Terms of Use

Rules: 

These Terms and Conditions (“Terms”) govern your use of the property sourcing and consultancy services provided by Decent Properties. By engaging our services, you agree to be bound by these Terms.

Nature of Services

We offer three primary services:

  • Consultancy & Property Sourcing: We assist international clients in locating, assessing, and navigating UK property investment opportunities.
  • Third-Party Referrals: We connect clients with solicitors, brokers, agents, etc.
  • Joint Ventures (JVs): We may offer select clients the opportunity to enter into joint property ventures, subject to a separate written agreement.

Note: We are not a regulated investment or financial services provider. We do not manage client funds unless otherwise stated in a formal JV agreement.

Eligibility

You must be at least 18 years old and legally able to enter into a binding contract. It is your responsibility to comply with relevant laws in your jurisdiction.

Scope of Services

  1. Consultancy & Property Sourcing:
  • Area insights, market guidance, and strategic planning
  • Property identification and shortlisting
  • Virtual/in-person viewings (as agreed)
  • Introductions to qualified third-party professionals
  1. Joint Venture Opportunities (If Applicable):
  • Participation in JVs is optional and subject to our discretion and suitability checks.
  • JV terms, contributions, roles, and profit-sharing arrangements are set out in a separate JV Agreement.
  • JV agreements may include shared ownership structures, development projects, or profit-split arrangements.
  • No JV is final or binding until a formal JV Agreement is signed by all parties.
  1. Third-Party Services and Liability

We may introduce you to third-party service providers. These are independent entities, and we are not responsible for their actions or outcomes. Always conduct your own due diligence.

Fees and Payment

  • Fees for consultancy and sourcing services will be quoted in advance.
  • JV contributions (if applicable) will be detailed in the individual JV Agreement.
  • Fees are non-refundable unless otherwise agreed in writing or required by law

No Investment or Financial Advice

We do not provide financial, legal, tax, or regulated investment advice.
You are encouraged to consult independent advisors before acting on any property transaction or JV opportunity.

Client Responsibilities

  • Provide accurate information and documents upon request.
  • Make timely decisions to avoid missed opportunities.
  • Engage with third parties directly and responsibly.

Joint Ventures: Special Terms

If you participate in a Joint Venture:

  • Each party’s roles and responsibilities will be clearly set out in the JV Agreement.
  • Returns are not guaranteed, and all investments carry risks including market risk, delays, or losses.
  • JV projects are not pooled investment schemes, and we do not act as fund managers.
  • Disputes arising from a JV will be resolved according to the dispute resolution clause in the JV Agreement.

Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential losses.
  • We are not liable for decisions made based on our guidance, or the actions of third parties.
  • In Joint Venture arrangements, our liability is limited as defined in the respective JV Agreement.
  • Our total liability under these Terms is limited to the total amount paid to us for the specific service in question

 

Confidentiality

  • We treat client information as confidential. Data will only be shared with third parties for legitimate service purposes, and always in accordance with UK data protection laws (including UK GDPR).

Amendments

  • We reserve the right to modify these Terms. Clients will be notified of significant changes, and continued use of our services after updates constitutes acceptance.
